DISK VENDOR COPYING RESTRICTIONS
Disk vendors (i.e. those who sell shareware disks) are granted
permission to copy the Merit Software shareware disks only under the
following conditions. Exceptions to these conditions must be
received in writing from Merit Software or their publishers D&E
Software Services.
1. You may not charge for Merit Software programs unless you are an
approved vendor. Approved vendors are vendors who have agreed to
meet various standards involving presentation of the shareware
concept. Vendors who wish to apply for approved vendor status may

2. All vendor advertisements and brochures publicising Merit
Software programs must state that, "Shareware programs require
separate payment to authors if found useful." This explanation must
immediately follow the price (including "free" if used) or be tied
to the price with an asterisk. The wording may be changed only with
prior written approval from Merit Software or their publishers D&E
Software Services.
3. Approved vendors will make an attempt to educate users on the
nature of shareware. Although this can be written in the vendor's
own words, it must address the following concepts:
i) The fee paid to the vendor is a distribution charge and does not
cover the cost of the program itself.
ii) If the user finds a shareware program to be of use, he/she is
expected to send the registration fee to the author.
iii) Registration entitles the user to various rights and benefits
(depending on the author). These range from the legal right to
continue using the software, to printed documentation and/or higher
levels of service.
4. Approved vendors will respect the copyrights and distribution
restrictions made by Merit Software.
5. Approved vendors will provide a written notice covering the
three concepts in section 3 above with all Merit Software programs
shipped. If the vendor distributes Merit Software programs in
pre-packaged wrappers, then this notice must be on the outside or
visible part of the package. Approved vendors will not claim to
be selling Merit Software programs except in situations where they are
an authorized retail reseller for a program and the distinction
between duplication fees for trial programs and full licensing is
made clear.
6. Vendors will not change or delete any files supplied with the
program(s), nor may they add any additional or supplementary files
to any disks. Vendors may not place the programs on disks
containing programs by other authors, and the programs may not be
sold as part of some other more inclusive package.
7. A distribution cost may be charged for the cost of disk(s),
carriage and labour. This cost may not to exceed £2.50 or US$3.00
regardless of disk size.
8. You may only distribute Merit Software programs if you received
the master disks directly from Merit Software or their publishers
D&E Software Services. You may not distribute copies of Merit
Software program disks if you received the master copy from any
other source. Approved disk vendors may not assign rights to or
approve any other person or company to distribute Merit Software
programs as shareware. In connection with this, approved disk
vendors agree not to include any Merit Software programs in their
libraries when selling copies of their libraries to any person or
company.
9. You may only distribute the shareware version disks. These
disks are created specifically for club, disk vendor and BBS
distribution. They can be identified by the words "Shareware
version" on the initial program screen, and by a shareware message
on the last screen. Please note that these are not crippled versions
of the program and the only difference between the shareware version
disks and the fully registered program is the shareware message.
10. The program(s) cannot be sold as part of some other more
inclusive package.
11. The program(s) cannot be rented or leased to others.
12. Any documentation that is supplied on disk or in printed form by
Merit Software cannot be copied or reproduced in any way, except as
allowed for when duplicating disks to be distributed under the
shareware regulations listed in this document.
13. Approved disk vendors agree to immediately stop distributing any
and all Merit Software programs when requested to do so by the
author, including but not limited to earlier versions of programs
and discontinued programs.
